Web Use Policy

The Kansas State Historical Society requires everyone wanting to use materials on a web site to complete and return a permission form (.pdf). Materials obtained from the Kansas State Historical Society for the purpose of web site use are subject to the following conditions:

1. Image Manipulation: The Kansas State Historical Society's primary interest is to protect the integrity of the original. The Kansas State Historical Society will NOT allow inversion of the original or the removal (except for allowable cropping) or addition of content. We will allow adjustments to contrast and sharpness. Images may be cropped at the edges or a portion may be selected from within a photograph. An explanatory statement must be added describing any changes. Any manipulation of the materials beyond that stated in the policy must be approved by the Curator of Photographs.

2. Resolution: The Kansas State Historical Society will NOT allow an image higher than 100 dpi to be placed on a web site. Exceptions must be approved by the Curator of Photographs and will require an additional charge.

3. Complimentary Copy: In those limited cases when the Kansas State Historical Society does allow members of the public to make digital copies of materials, we request a complimentary copy of the digitized images at the highest resolution for the Society's research collections.

4. Credit Line: The credit line must read Kansas State Historical Society, Copy And Reuse Restrictions May Apply. This statement must be placed near the image and linked to our web use policy at www.kshs.org/research/collections/documents/photos/webuse.htm.

5. Ownership: The Kansas State Historical Society does not claim exclusive ownership of the rights to all the images in our collection. We are simply granting permission to reproduce from images in our collections. All users are required to complete a permission form. We also strongly urge users to link to our permission and use page at www.kshs.org/research/collections/documents/photos/permissionfees.htm from all web pages containing images from our collection.

6. Endorsement: Use of materials from the Kansas State Historical Society on a web site does not imply that the Society endorses any product, enterprise, expressed opinions, or confirms the accuracy of any content on that site.

7. Indemnification: The user agrees to defend, indemnify, save, and hold harmless the Kansas State Historical Society, its employees, officers or designates, from any and all costs, expense, damage and liability arising because of any claim whatsoever which may be presented by anyone for loss or damage or other relief occasioned or caused by the release of said photographs, prints, and audiovisual materials to the user and their use in any manner, including publication, reproduction, broadcast, web publication, digital imaging, display, duplication or printing by anyone for any purpose whatsoever.

8. Use Fee: The Kansas State Historical Society charges commercial users $50.00 and non-profit users $5.00 per image, in order to support the preservation and maintenance of the collections. Citizens and businesses in the State of Kansas are not charged use fees. The images may be distributed via the World-Wide Web, as part of a single online display, exhibit, site, or online collection. Any additional or different use of the image(s) will require renegotiation.

9. Change: All policies are subject to change. In case of a discrepancy, policies in effect at the time payment is made will apply.
