Re: Section 106 Consultation

In order to quickly and efficiently complete the consultation process for projects subject to review under Section 106 of the National Historic Preservation Act (1966, as amended), the Kansas State Historic Preservation Office (SHPO) requires the information listed below. Submission of all information along with the initial request for consultation will shorten the time necessary for project review and prevent potential delays. Please provide our office with the following information:

Requests for consultation must be in writing and addressed to:

Please provide a cover letter clearly indicating the county and city within which the project will take place and a sentence stating that the letter is a "request for consultation regarding the proposed project in accordance with 36 CFR 800." Provide a project name and number (if available), along with the name, address, and telephone number of a contact person. Also indicate the name of the person or entity requesting consultation if different from the contact person, and the federal or state agency for which review is required.

Describe the project in detail; for projects involving Ground Disturbance/Earthmoving Activities (i.e. fiber-optic lines, water lines, reservoirs, roads), see that section below; for projects involving Construction/Rehabilitation/Demolition of structures see that section below. If your project involves both Ground Disturbance/Earthmoving and Construction/Rehabilitation/Demolition (i.e. cellular towers, commercial developments, sewage or water treatment plants) please refer to both sections.

Consultation should be completed as early as possible in the permit process, but not before final or near-final project plans are available. Projects for which the exact alignment or project area is not known cannot receive final clearance.

Ground Disturbance/Earthmoving Activities

On the reference line of the cover letter please provide the county, city, township, range, and section within which the project will take place. In the cover letter or on additional pages provide a complete description of the proposed project. If the project involves excavation indicate depth and extent; also, state whether cut and fill will be utilized. For linear projects such as fiber-optic or water line installations indicate the type of construction equipment to be utilized (i.e. backhoe or static plow).

Provide relevant copies of USGS 7.5' topographic maps of the project vicinity with the project area clearly marked (outlined or highlighted) with an arrow pointing to the project boundary. For projects requiring large land areas such as water treatment plants, reservoirs, commercial/residential developments, etc., please indicate the project boundary within which all construction activities will take place. USGS topographic maps can be downloaded from http://www.topozone.com/. Maps should be printed at a scale of 1:24,000 or 1:25,000. The map name and date should be clearly indicated on the map.

If the project will utilize existing public right-of-way please clearly indicate those areas on the topographic map. Also, clearly indicate areas where existing, non-public right-of-way will be utilized or areas where new right-of-way or easements will be purchased, if applicable.

Provide copies of final or near-final construction plans. All detail sheets are not necessary; however, provide at least one drawing illustrating the project boundary, existing topography, proposed cut and fill, proposed buildings, parking lots, ponds, and other major construction features.

All areas of proposed construction and/or ground disturbing activities must be indicated on the project and topographic maps, including: access roads, construction lay-down areas, borrow areas, boring pads, etc.

Construction/Rehabilitation/Demolition

On the reference line of the cover letter please provide the county and city within which the project will take place. In the cover letter or on additional pages provide a complete description of the proposed project. If the project entails complete demolition of a structure please clearly state this. If the project entails rehabilitation or modification to an existing structure completely describe the type of activity and materials to be used.

Please provide one photograph (minimum of 3 ½ x 5 inches, color or black/white) showing a full front view of each structure to be impacted by the project. Photographs should be supplied for all buildings, houses, bridges, train trestles, etc. to be impacted. If available, please provide the known or approximate date of construction of each structure.

If the proposed project will entail Ground Disturbance/Earthmoving activities and the Construction/Rehabilitation/Demolition of structures please review both sections above and provide all of the information requested.

Checklists

Summary checklists are provided below to assist in the preparation of a request for consultation. It is not necessary to include the checklists with your request; checklists are provided only to assist with the compilation of the necessary material. If the project involves both types of construction activity please provide all of the information requested in both checklists.
